By accessing or using Assistral’s website (https://www.assistral.com) and our AI‑powered voice booking service (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please discontinue use immediately. Continued use constitutes acceptance of any updates.

2. Eligibility
You must be at least 16 years old and legally capable of entering binding agreements. By providing a phone number and opting in, you represent that you meet these requirements.

3. Service Description
Assistral provides an interactive voice booking agent that allows you to schedule, reschedule, or cancel appointments via phone call, and delivers confirmations and reminders via SMS and email.

4. User Consent & Opt‑In
By submitting your phone number through our website form or verbally during a call, you explicitly consent to receive SMS messages from Assistral as described in Section 5. We record and retain proof of consent in accordance with A2P 10DLC requirements.

5. SMS Messaging Terms

  • Content & Frequency: Transactional messages only (appointment confirmations, reminders, reschedules, cancellations). Msg frequency varies.

  • Costs: Msg & data rates may apply.

  • HELP & STOP: Reply HELP for assistance or email info@assistral.com. Reply STOP to unsubscribe immediately; you will receive a confirmation of your opt‑out.

6. Privacy & Data Protection
Your use of our Service is subject to our Privacy Policy, available at https://www.assistral.com/privacy. That Policy describes what information we collect, how we use it, how we share it, and your rights.

7. User Obligations & Restrictions
You agree not to:

  • Use the Service for any unlawful, harassing, fraudulent, or abusive purposes.

  • Attempt to interfere with or disrupt the integrity or performance of the Service.

  • Reverse‑engineer, decompile, or disassemble any portion of the Service.

8. Third‑Party Services
We integrate with third‑party providers (e.g., SMS gateways, calendar platforms). Your data is processed under their respective policies and in compliance with applicable laws (GDPR, TCPA, etc.).

9. Intellectual Property
All content, branding, and software underlying the Service are the exclusive property of Assistral or its licensors. No rights are granted to you other than as expressly set forth in these Terms.

10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. ASSISTRAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ASSISTRAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF $100 USD OR AMOUNTS YOU HAVE PAID US IN THE PRIOR 12 MONTHS.

12. Indemnification
You agree to indemnify, defend, and hold harmless Assistral and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third‑party rights.

13. Termination
We may suspend or terminate your access at any time for violation of these Terms or for any other reason, without notice. You may opt out of SMS at any time by replying STOP; all messaging will cease promptly.

14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict‑of‑law principles. Any dispute will be resolved exclusively in the state or federal courts located in New York County, New York.

15. Modifications to Terms
We may update these Terms from time to time. We will post the revised Terms at https://www.assistral.com/terms and update the “Effective Date.” Continued use after updates constitutes acceptance.
